Welcome to Lab Gear Supply! By accessing or using our website (labgearsupply.com) or purchasing our products, you (the “Buyer”) agree to be bound by these Terms of Service (ToS) and our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use our services or purchase our products.

1. Agreement to Terms

  • This ToS constitutes a legally binding agreement between you, the Buyer, and Lab Gear Supply, a company incorporated in the State of Oregon, USA.
  • You must be at least 18 years old to use our services or make a purchase. By using our services, you confirm that you are legally able to enter into this agreement and comply with all applicable laws.

2. Orders and Payment

  • Order Acceptance: All orders are subject to acceptance by Lab Gear Supply. We may refuse or cancel an order for any reason, including product availability, pricing errors, or suspected fraud, and will notify you if this occurs.
  • Payment Terms: We accept major credit cards (Visa, MasterCard, American Express, Discover), PayPal, and bank wire transfers for orders over $1,000. Payment must be made in full at the time of purchase. We do not store your credit card information; all transactions are processed securely through our payment gateway.
  • Pricing and Taxes: All prices are in U.S. dollars and subject to change without notice. Prices do not include taxes or shipping fees, which will be calculated at checkout. You are responsible for any applicable sales taxes or duties, except as noted in Section 3 for international orders.

3. Shipping and Delivery

  • Shipping Policy: We ship within the U.S. and internationally. Shipping costs and estimated delivery times are provided at checkout. Lab Gear Supply is not responsible for delays due to customs, carrier issues, weather, or other factors beyond our control.
  • Risk of Loss: Risk of loss and title for products pass to you upon delivery to the shipping carrier. You are responsible for filing claims with the carrier for lost or damaged shipments.
  • Inspection Period: You have 7 calendar days from the delivery date to inspect your order for missing or damaged items. Please contact us at support@labgearsupply.com or (503) 263-3330 if you encounter any issues.
  • International Orders:
    • Lab Gear Supply is not responsible for any duties, tariffs, taxes, or other fees imposed by your country on international orders. These costs are your sole responsibility, and we recommend checking your local regulations before ordering.
    • We will not return or refund orders that are refused by you, the Buyer, or by your government due to non-compliance with local policies, customs regulations, or any other reason. By placing an international order, you accept full liability for adhering to your local policies, and any associated risks or costs are yours alone.

4. Returns and Refunds

  • Defective or Incorrect Items: If a product is defective, damaged, or incorrect, contact us within 14 days of delivery. We’ll provide a prepaid shipping label and either replace the item or issue a full refund, at your choice, within 7 business days of receiving the returned item.
  • Non-Defective Returns: You may return non-defective, unused items within 30 days of delivery for a refund, subject to a 15% restocking fee. You are responsible for return shipping costs unless the return is due to our error. Items must be returned in original condition, including all packaging, manuals, and accessories.
  • Non-Returnable Items: Custom orders, opened consumables, and items marked as final sale are non-returnable unless defective. Additionally, as noted in Section 3, international orders refused by the Buyer or government are not eligible for return or refund.

5. Product Use and Safety

  • Intended Use: Our products are intended for professional use in the cannabinoid processing industry. You are solely responsible for using them in accordance with all applicable laws, regulations, and safety guidelines.
  • Power Compatibility: Products are designed for 110/120V power unless specified. Using power converters or operating equipment outside the specified voltage may result in damage, and Lab Gear Supply is not liable for such damage.
  • Buyer Responsibility: You assume all risks associated with the use, storage, and disposal of our products. Lab Gear Supply is not responsible for any injury, damage, or loss resulting from improper use, modification, or failure to follow safety guidelines.

6. Release of Liability

  • Limitation of Liability: To the fullest extent permitted by law, Lab Gear Supply, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of our products or services, even if we have been advised of the possibility of such damages.
  • Maximum Liability: Our total liability for any claim arising from this agreement shall not exceed the amount you paid for the product or service in question.
  • No Liability for Misuse: Lab Gear Supply is not liable for any damages, injuries, or losses resulting from misuse, abuse, or unauthorized modification of our products, or from your failure to comply with applicable laws or safety standards.
  • Third-Party Actions: We are not responsible for the actions or omissions of third parties, including shipping carriers, customs authorities, or other service providers involved in the delivery or use of our products.

7. Warranty Disclaimer

  • As-Is Products: Products are sold “as-is” unless otherwise specified. We make no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose, except as explicitly stated in our warranty policy.
  • Limited Warranty: For products with a manufacturer’s warranty, we will facilitate repairs or replacements as per the warranty terms. However, Lab Gear Supply is not liable for any defects caused by misuse, neglect, or unauthorized repairs.

8. Intellectual Property

  • All content on our website, including text, images, logos, and product designs, is the property of Lab Gear Supply and protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

9. Governing Law and Dispute Resolution

  • Governing Law: These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of law principles.
  • Arbitration: Any disputes arising from this agreement will be resolved through binding arbitration in Clackamas County, Oregon, following the rules of the American Arbitration Association. You waive the right to participate in a class action lawsuit or class-wide arbitration.
  • Jurisdiction: If arbitration is not applicable, you agree to submit to the exclusive jurisdiction of the courts in Clackamas County, Oregon.

10. Indemnification

  • You agree to indemnify, defend, and hold harmless Lab Gear Supply, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of our products or services, violation of these terms, or infringement of any third-party rights.

11. Changes to These Terms

  • We may update these terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.
